These Terms of Service (“Terms”) govern your use of the CRM services, software, websites, and related applications (collectively, the “Service”) provided by DC PATEL EDUCATORS LLC doing business as MAJESTIC WEALTH BUILDERS (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old and able to enter into legally binding agreements to use the Service. By using the Service, you represent that all information you provide is accurate and complete.

2. Account Registration

You must create an account to access the Service. You agree to:

3. Use Of The Service

You agree NOT to:

Use the platform to send unsolicited or unauthorized communications (spam)

Violate any SMS, email, or telemarketing regulations, including TCPA, CAN-SPAM, and carrier compliance rules

We may suspend or terminate your account for misuse.

4. Customer Data & Privacy

You retain ownership of data you input into the Service (“Customer Data”). You grant us a license to store, process, and use the data solely for providing the Service.

We do not use Customer Data for marketing or promotional purposes by any outside organization.

You are solely responsible for ensuring that your collection and usage of contact information complies with applicable privacy, data, and consent laws.

5. Communications & Compliance

If the Service enables SMS, email, calls, or other messaging capabilities, you agree to:

Obtain proper opt-in consent from your contacts

Provide opt-out mechanisms

Comply with all telecommunications laws and carrier rules

Avoid prohibited content (illegal, harmful, abusive, deceptive, etc.)

You assume all liability arising from your messaging practices.

5A. SMS Messaging Program Terms (Program Name, Help, STOP, Rejoin, Disclosures)

Program Name: Majestic Wealth Builders SMS Program

Program Description: By opting in, you agree to receive SMS/text messages from DC PATEL EDUCATORS LLC DBA Majestic Wealth Builders. Message types may include transactional messages (such as appointment reminders, confirmations, and account/service notifications) and, if you separately opt in, marketing and promotional messages (such as educational updates, webinar/event invitations, and special offers). Message frequency may vary.

Opt-Out Instructions: You can cancel SMS messages at any time by texting STOP to the shortcode or phone number you received the message from. After you send STOP, we will send a confirmation message to confirm you have been unsubscribed. After that, you will no longer receive SMS messages from us.

Rejoining Instructions: If you opt out and later want to rejoin, you may re-enroll by signing up again through the same opt-in method you used originally (for example, the website form), and we will resume sending SMS messages to you. Where available, you may also text START to re-subscribe.

6. Fees & Payments

If the Service is offered on a paid subscription:

Fees are billed in advance on a recurring basis unless otherwise stated

All payments are non-refundable unless required by law

We may modify pricing with notice

Failure to pay may result in suspension or termination

7. Intellectual Property

All software, content, and materials provided by us remain our property. You receive a limited, non-exclusive, non-transferable license to use the Service for your business use only.

You may not copy, reverse engineer, resell, or redistribute our software or features without permission.

8. External Integrations & Service Providers

The Service may integrate with external tools (such as email gateways, phone carriers, and payment processors). We are not responsible for:

Downtime of external providers

Data practices of external providers

Fees charged by external providers

Your use of external tools is governed by the terms and policies of those providers.

9. Termination

We may suspend or terminate your account if:

You violate these Terms

Required payments are not made

You misuse or abuse the platform

Upon termination, your access to the Service will be revoked, and we may delete your data as permitted by law.

10. Disclaimer Of Warranties

The Service is provided “as-is” and “as available”.

We make no warranties regarding:

Uptime or availability

Accuracy of data

Fit for a particular purpose

Use of the Service is at your own risk.

11. Limitation Of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages

Our total liability is limited to the amount paid to us in the last 12 months

Certain jurisdictions may not allow these limits; if so, they apply to the extent permitted
